Terms of Service

Legal terms for our beekeeping services

1. Service Agreement

By requesting a site assessment or entering into a service contract with Conroe Bee Company, you agree to these terms and conditions.

2. Site Assessment

  • Site assessments are confidential and for the use of the property owner.
  • An assessment visit does not obligate you to purchase our services.
  • A small deposit may be required to schedule an assessment; this is credited toward service fees if you proceed.

3. Service Tiers & Pricing

  • Pricing is provided in a written proposal and is valid for 30 days unless otherwise specified.
  • We offer three main service tiers (Tier 1, 2, and 3). Details are provided in the proposal.
  • Pricing may vary based on property size, hive count, appraisal district regulations, and other factors.
  • We reserve the right to adjust pricing if significant scope changes occur (e.g., property size changes, hive count adjustments).
  • Travel surcharge: Sites located more than 20 road miles from Conroe, Texas may include a travel surcharge. Any travel surcharge will be disclosed in writing in the proposal before services begin.

4. Contract Term & Payment

  • Minimum contract term is one year.
  • Payment terms are specified in the proposal (annual, seasonal split, or quarterly).
  • Late payments may incur fees or suspension of services.
  • After year one, we can discuss rolling contracts, multi-year discounts, or other arrangements.

5. Hive Placement & Management

  • We place hives at locations deemed suitable for hive health and your property layout.
  • You grant us access to your property during scheduled visits.
  • You agree not to apply broad pesticides during active bee season (March–October) without coordinating with us.
  • Major property changes (construction, tree removal, land use change) may affect hive placement or service delivery.

6. Insurance & Liability

  • We maintain Commercial General Liability insurance for hive placement, management, and visits on your property. Certificate of insurance (COI) available on request.
  • Honeybees are generally docile when properly managed, but stings can occur. We are not liable for injuries or damage from bee stings unless directly caused by our negligence.
  • We are not liable for damage caused by weather, wildlife, acts of God, or property owner negligence.
  • For serious incidents, please report to our insurance carrier as specified in the service agreement.

7. Colony Health & Replacement

  • We manage hives to maintain health, but colony loss can occur due to disease, pests, environmental factors, weather, vandalism, or pesticide exposure.
  • We monitor for common diseases (varroa mites, American foulbrood) and treat preventatively.
  • If a colony is lost, CBC makes best-effort replacements to maintain contracted colony counts, subject to seasonal availability, weather, and supplier constraints. Replacement timing is at CBC's operational discretion.
  • Colony loss does not trigger a refund or reduce the contract balance.

8. Agricultural Exemption

  • We provide documentation and records to support your agricultural valuation (ag exemption) application or renewal.
  • We are not a law firm or tax advisor. Consult your accountant or attorney on exemption strategy.
  • Agricultural valuation decisions are made by the appraisal district, not by us. We cannot guarantee approval or tax outcomes.
  • If your exemption is challenged or denied, we provide documentation for your defense, but the appraisal district makes the final determination.

9. Property Access

Client must provide CBC with 24-hour access to the apiary area for the term of service, including by gate code, lockbox, key, or other agreed method. CBC will coordinate routine visits when practical, but may access the property without advance notice for time-sensitive colony welfare, safety, or security issues. Failure to maintain access may limit CBC’s ability to provide services and documentation.

10. Cancellation & Termination

  • Removal process: Written notice is required; standard minimum 30 calendar days.
  • Payment obligation: Early removal or termination does not cancel payment for the remaining contract term. The early termination fee equals the remaining contract payments through the end of the agreed term.
  • Access & timing: Apiary removal timing is subject to weather, safety, and routing constraints. Removal is not an emergency service.
  • Telemetry hardware on removal: If your site has telemetry equipment, CBC retains ownership of all sensors, gateways, and mounting hardware. Hardware will be retrieved during apiary removal or within 30 days thereafter. Client must provide access for hardware retrieval. Any hardware damage caused by the client or third parties may be invoiced at replacement cost.
  • Relocation option: In some cases, CBC may relocate hives to another qualifying property you own within our service area, subject to site feasibility and scheduling.
  • CBC-initiated termination: We reserve the right to terminate services if you violate terms (e.g., broad pesticide application without coordination, non-payment, property access denial).
  • Past-due balances: Invoices unpaid 30 days after due date accrue a late fee of 1.5% per month (or the maximum permitted by Texas law, whichever is lower). Accounts unpaid after 90 days may be referred to a third-party collections agency; client is responsible for reasonable collection costs and attorney fees to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Conroe Bee Company's total liability for any claims arising from this service agreement is limited to the amount you paid for services in the 12 months preceding the claim.

12. No Guarantee of Results

While we believe our services will help you qualify for or maintain agricultural valuation, we cannot guarantee appraisal district approval or valuation retention. Agricultural valuation decisions are at the appraisal district's discretion.

13. Confidentiality

We treat all property owner information and site assessments as confidential. We do not disclose property details without your permission.

14. Governing Law

This agreement is governed by the laws of the State of Texas. Any disputes will be handled in Montgomery County, Texas courts.

15. Changes to Terms

We may update these terms periodically. Changes will be communicated in writing or posted on this page.
